Terms and Conditions

These terms and conditions are in relation to business and work carried out by The Balance and it's owner.

By accessing or using the service you agree to be bound by these terms and conditions. If you disagree with any part of the terms you many not access the service.

1) Introduction

The Balance is a subscription based service. The contract allows the company to take either monthly or annual payments from the customer on set dates once a contract is formed between the customer and the company. This payment will continue until subscription is cancelled by either the customer or the company, see appendix 5 and 6 for details.

 

2) Supply

The company agrees to supply the products or services to the customer as detailed in the order and according to the terms and conditions of the contract. We reserve the right to change, modify or remove the content or the services from time to time to comply with new laws or regulations or to update our offerings. We also reserve the the right to modify or discontinue all or part of the services if The Balance was to close down or if we decide to change the company's business offering. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the services.

We cannot guarantee the services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance relating to the services, resulting in interruption, delays or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the services form time to time and will endeavor to give you notice of such changes. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the services during any downtime or discontinuance of the services.

Nothing in these terms and conditions will be construed to obligate us to maintain and support the services  or to supply any corrections, updates, or releases in connection therewith.

3) Rights reserved

Should the company choose not to enforce any or all of these conditions it should not be interpreted as a waiver of any of the company's rights. By providing the company with an order, the customer accepts these terms and conditions.

4) Health and Safety

The company and customer will act in accordance with all relevant health and safety requirements in order to provide the products or services. The Balance accepts no liability whatsoever for any injuries or illness sustained by participating in any of the activities provided.

The contents provided by the company is to be used as a guide only. The contents should not be used as a medical aid in replacement to any advice given by a Doctor or health professional. If the customer is new to fitness, coming back to fitness, or recovering from an injury or illness, it is advised by the company to seek advice from your Doctor or health professional before attempting to get involved with any of the content provided by the company.

5) Your right to cancel

You have a right to cancel your subscription at any point. It is required to provide 14 days notice of cancellation before next payment is due, this is to give time to cancel the direct debit. If paying annually, cancellation can only be after that year is concluded, refunds will not be issued unless extenuating circumstances agreed by the owner directly.

6) The company's right to cancel

The company can cancel the customer's subscription at any time for any of the following reasons:

  • Failure of payment

  • Failure of following the company's guidelines (see appendix 7)

  • Copying and distributing contents without the owners permission

  • Detrimental behaviour towards the company by the customer

7) Codes of conduct 

Whilst utilising the services we require you the customer to behave in a manor compliant of the company's standards. Any bullying, bad language, harassment, or racially detrimental behaviour will not be tolerated and will result in immediate termination of the customer's membership.

Usage of any of the contents provided by the company is for personal use to the customer only, any copying, public showcasing, or distributing of the contents will result in immediate termination of the customer's membership.

8) Data and passwords

This service requires the customer to register an account with the company. Please select a password that would not be obvious to someone trying to guess your password, and change it regularly as an added precaution. You the customer are responsible for maintaining the confidentiality of the password and account, and you are fully responsible to all activities that occur under your password or account identification. You agree to immediately notify The Balance of any unauthorised use of your password or account or any other breach of security. Without limiting any rights which the balance may have of the sites and your account, including without limitation terminating your account, changing your password. or requesting additional information to authorise transactions on your account.

The security of your personally identifying information is important to us. While there is no such thing as "perfect security" on the internet, we will take reasonable steps to help ensure the safety of your personally identifying information. However, you understand and agree that such steps do not guarantee that use of the site is invulnerable to all security breaches, and that The Balance makes no warranty, guarantee, or representation that use of any of our site is protected from viruses, security threats or other vulnerabilities.

9) Copyrighting and contents

All contents provided by the company is owned and created by the owner of The Balance. Under no circumstances is it to be copied, publicly showcased or distributed by anyone other than the owner. Any content provided has been written and collated by the owner, any content relating to anyone else or any other work is purely coincidental. Any contents obtained by another person is documented with their details at the point of source.
